Ticket Terms & Conditions

Thank you for joining us for the Dark Sky Festival on Lord Howe Island.

Please read these Terms & Conditions carefully before purchasing a ticket to a Festival event. By completing a purchase, you acknowledge and agree to these Terms & Conditions.

1. Ticket Purchases

Tickets to Dark Sky Festival events are non-refundable, except where a refund is expressly provided for under these Terms & Conditions or where a refund or other remedy is required under Australian Consumer Law.

Please check the event date, time and details carefully before completing your purchase.

2. Tickets Are Transferable

While tickets are non-refundable, they are transferable to another person.

If you are unable to attend an event, you are welcome to give your booking to someone else. As there are no physical tickets, the new attendee will simply attend under the original booking name or provide the relevant booking details on arrival.

The Dark Sky Festival Committee does not facilitate the resale of tickets and is not responsible for any private arrangements or payments made between individuals when transferring a booking.

3. No Refunds for Changes to Personal Circumstances

Refunds will not be provided where a guest is unable to attend an event due to personal circumstances, including:

  • a change of plans;

  • illness or injury;

  • missed or delayed flights;

  • flight cancellations;

  • accommodation or transport issues;

  • changes to travel arrangements; or

  • any other circumstance preventing attendance.

Where possible, guests are encouraged to transfer their booking to another person.

4. Flight Delays and Cancellations

We understand that travelling to Lord Howe Island can involve circumstances outside your control.

If you are unable to attend a Festival event because your flight to or from Lord Howe Island has been delayed or cancelled, we are happy to provide a letter confirming your non-attendance at the event.

This letter may be provided to your travel insurance provider in support of a claim. The acceptance of any claim, and any decision regarding reimbursement, is a matter between you and your insurance provider and is not determined by the Dark Sky Festival Committee.

Please contact us if you require a confirmation of non-attendance.

5. Weather Conditions

The Dark Sky Festival is an island-based festival, with many events taking place outdoors or involving outdoor activities. Weather conditions can therefore play a role in the delivery of some events.

Rain, cloud, wind, cooler temperatures or other less-than-ideal weather conditions do not, in themselves, entitle guests to a refund.

Every reasonable effort will be made to proceed with events where it is safe and practical to do so.

The Festival Committee may make reasonable changes to event locations, timings, formats or activities where required due to weather or other circumstances.

6. Cancellation Due to Severe Weather or Safety Concerns

The safety of our guests, performers, presenters, staff, volunteers and event providers is our highest priority.

If a severe weather warning or other significant safety concern is issued and the Dark Sky Festival Committee determines that an event cannot safely proceed, the event may be cancelled or postponed.

If the Festival Committee cancels an event because severe weather or another significant safety concern means that it is unsafe for the event to proceed, guests will be notified as soon as reasonably practicable and a refund will be provided for the cancelled event, subject to any rights or remedies available under Australian Consumer Law.

A refund will apply only to the event that has been cancelled.

7. Changes to the Festival Program

The Festival Committee reserves the right to make reasonable changes to the Festival program, including changes to:

  • performers or presenters;

  • event schedules;

  • venues or locations;

  • event formats;

  • activities; and

  • advertised program elements.

Where an event can reasonably proceed, changes of this nature will not ordinarily entitle guests to a refund.

Where a significant change means that an event can no longer reasonably be regarded as the event purchased, any rights of the guest will be considered in accordance with Australian Consumer Law.

8. Event Cancellation or Postponement

In circumstances where an event is cancelled or postponed due to circumstances beyond the reasonable control of the Festival Committee, including severe weather, natural disaster, emergency, government direction or other significant safety concerns, we will communicate the situation and available options to affected guests as soon as reasonably practicable.

Where a refund is offered or required, it will generally be made to the original purchaser using the original payment method.

9. Travel and Accommodation

Dark Sky Festival event tickets do not include flights, accommodation or other travel arrangements unless expressly stated at the time of purchase.

The Festival Committee is not responsible for costs incurred by guests in relation to flights, accommodation, transport, meals or other travel arrangements where an event is cancelled, postponed or changed.

We strongly recommend that visitors consider appropriate travel insurance when making arrangements to attend the Festival.

10. Event Entry

There are no physical tickets for Dark Sky Festival events.

Bookings are recorded on the Festival’s guest list and entry is provided to the person named on the booking.

If a booking has been transferred to another person, the new attendee may be asked to provide the original booking name or relevant booking details upon arrival.

11. Australian Consumer Law

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable legislation.

Where a guest has a statutory right to a refund, replacement, cancellation or other remedy, those rights continue to apply.

12. Acceptance of These Terms & Conditions

By purchasing a Dark Sky Festival event booking, you acknowledge that you have read and accepted these Terms & Conditions.

The Terms & Conditions applying to your purchase are those displayed at the time of purchase, subject to any rights you may have under applicable law.
